Terms of Service

These Terms of Service (the “Terms”) govern access to and use of polefx.com, other websites and online services operated by PoleFX, and PFX Bot, our Discord application (together, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

Our websites provide information about PoleFX, its products, projects, and business. PFX Bot is an AI-enabled assistant intended to support PoleFX business operations through Discord. Features may change over time. Product purchases, warranties, returns, and other commercial transactions may be governed by additional terms presented at the time of purchase.

2. Eligibility and authority

You must be at least 13 years old and old enough to consent to use the Services where you live. If you add PFX Bot to a Discord server, you represent that you have permission to do so and to authorize its requested permissions.

3. Acceptable use

You may not use the Services to violate any law, infringe another person’s rights, distribute malware, gain unauthorized access to systems or data, harass or deceive others, scrape the Services in a way that causes disruption, or interfere with the Services or their supporting systems. You may not attempt to bypass safeguards or extract credentials.

4. AI-generated output

PFX Bot may produce inaccurate, incomplete, or inappropriate output. You are responsible for reviewing output before relying on, publishing, or acting on it. Output is not legal, medical, financial, or other professional advice.

5. Content and intellectual property

The Services and their original text, graphics, software, branding, and other materials are owned by PoleFX or its licensors and are protected by applicable laws. You may use the Services for their intended purposes but may not copy, modify, distribute, or exploit our materials without permission except as allowed by law.

You retain any rights you have in content you submit. You grant PoleFX a limited license to host, copy, transmit, and process that content as needed to provide, secure, maintain, and improve the Services. You represent that you have the rights and permissions needed to submit it.

6. Third-party services and links

The Services may rely on or link to third-party services, including Discord and providers used for commerce, hosting, analytics, automation, and artificial intelligence. Their terms may also apply. PoleFX is not responsible for third-party services that it does not control.

7. Availability and changes

We may modify, suspend, or discontinue any part of the Services at any time. We do not guarantee uninterrupted, secure, or error-free operation or that website information will always be complete or current.

8. Suspension and termination

We may restrict access if we reasonably believe these Terms have been violated, a Service is being abused, or restriction is needed to protect users, PoleFX, or third parties. You may stop using the Services at any time, and an authorized administrator may remove PFX Bot from a Discord server.

9. Disclaimer

To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. This disclaimer does not replace any written product warranty or rights that cannot legally be excluded.

10. Limitation of liability

To the fullest extent permitted by law, PoleFX and its owners, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill arising from use of or inability to use the Services. Where liability cannot be excluded, our total liability relating to the Services will not exceed US $100. This limit does not apply where prohibited by law or to a separate obligation arising from a product purchase.

11. Changes to these Terms

We may update these Terms by posting the revised version here and changing the effective date. Continued use after an update means you accept the revised Terms.
